Over £1.1m Settlement for Mesh Injury for our client following successful mediation. The TVT Abbrevo mesh was implanted at East Sussex Healthcare NHS Trust in 2016. TVT Abbrevo is a type of obturator tape which is inserted by approach to the obturator foramen. It was a relatively new procedure and had considerable significant risks associated with it which the Claimant was not warned about.
There was a failure to consider conservative treatment options such as do nothing, pelvic floor muscle training, urethral bulking agent, TVT inserted retropubically, fascial sling or colposuspension.
As the TVT Abbrevo is inserted by approach to the obturator foramen it carries the risk of mesh erosion, damage to the groin including the obturator nerve and surrounding smaller nerves and risk of chronic pain. Once inserted the mesh was essentially permanent and removal involved complex and hazardous surgery. Such removal surgery caused further damage and scar tissue exacerbating chronic pain.
NICE Guidelines at the time advised that women offered a transobturator approach should be made aware of the lack of long-term data. This did not happen and the Claimant was injured. She suffered repeat surgeries to remove the tape and try and fix the damage caused. She suffered urine incontinence, groin pain, vaginal pain, reduced mobility and use of a wheelchair. Being young she had significant care needs and loss of earnings.
Breach of duty, causation and loss were denied but thankfully a settlement was achieved at mediation.

The Future
Discussing the implications for other mesh injured women, Dr Handley added “Whilst it was a good result for her, many other women who have suffered similar damage had received little to no compensation. There is an absolute failure of the Government to introduce a financial redress agency for victims of the mesh scandal. The blanket denial of liability from the NHS adds further distress to those suffering lifelong injury”. Action is needed now.
