Retained Placenta and Ashermans leads to chronic pain, infertility and miscarriage when the repeated D&C to remove products causes adhesions

We acted for a woman who gave birth and was readmitted with post-partum haemorrhage on two occasions.

She was not warned about the potential risks and complications of the D&C medical procedures which lead to adhesions and Ashermans Syndrome. The surgery removed of endometrial layer and caused adhesions.

Asherman’s syndrome from retained products of conception (RPOC) happens when scar tissue (intrauterine adhesions) forms inside the uterus after a surgical procedure like a dilation and curettage (D&C) or evacuation to remove leftover placental or fetal tissue. The trauma to the deep basal layer of the uterine lining during surgery triggers abnormal healing, causing the front and back walls of the womb to stick together.

The Claimant then suffered pain on monthly periods, absence of bleeding and infertility. After many investigations as to the cause of the Claimant’s symptoms she was diagnosed with Ashermans Syndrome.

In the Defence the Defendant made no admissions in respect of the available conservative treatments or the consent process. As to causation, the Defendant admitted that the Claimant developed adhesions in the lower uterus and cervical stenosis as a result of the operation on 28.06.2014.

Following careful negotiation the matter settled on an amicable basis.
