TVT Compensation Claim

TVT Compensation Claim is another important step for women harmed by transvaginal mesh.

The Claimant claimed compensation for clinical negligence pertaining to treatment from the Defendant in 2007 for TVT mesh.

The Claimant alleged that she was not properly assessed and the urodynamic studies confirm that she had detrusor over activity. TVT is not a treatment for the same. She was given wrong treatment.

She was not offered alternative treatment options or warned about the risks and complications of TVT. The Claimant underwent unnecessary surgery by way of TVT and hysterectomy. The Claimant suffered and will likely continue to suffer from chronic post-surgical pain to her pelvis and vagina. She experienced dyspareunia, an exacerbation of her pre-existing fibromyalgia and a worsening of her bladder symptoms with associated voiding difficulties and recurrent UTIs.

The Claimant suffered depression. She needed further surgery to remove all or part of the TVT mesh and/or treat her bladder conditions. The Claimant required a lengthy period of therapy to treat her psychological conditions. The Claimant relied on the medical reports from a Consultant Urogynaecologist, Consultant in Pain Medicine and Psychiatrist.

The Defendant denied the claim in full. They stated  that she suffered no injury from the mesh despite needing mesh removal. The defended the case on the basis that the TVT surgery was appropriate treatment. They alleged she was warned about the risks.

We settled her case by negotiation for compensation that will make a significant change to her life.

It is often difficult to understand how the Defendant Trust can deny liability for mesh. It is disappointing that mesh injured ladies still have to go through the legal process to obtain compensation.
