Woman Left Unable to Conceive Secures Damages
Woman Left Unable to Conceive Secures Damages for her infertility. Damages are designed to compensate for both the physical, psychological, and financial impact of the loss of fertility.
Infertility is a highly emotive issue. Our client was devastated and underwent invasive fertility treatments including in vitro fertilisation (IVF) when she struggled to conceive. It was emotionally difficult to manage and very expensive. The reason for her infertility was a previous D&C for earlier miscarriage which had left scar tissue (adhesions) in the uterus. She was later diagnosed with Asherman’s Syndrome after investigations.
A D&C causes a significant risk to fertility. Scar tissue formation inside the uterus, after the D&C procedure, increases the risk of infertility and miscarriage. The scar tissue can interfere with the menstrual cycle, thus affecting periods and ovulation. It can also interfere with implantation and placental development, thus leading to miscarriages.
Our client approached us as Specialist Solicitors to help with her claim. Importantly she wanted to highlight the risks of D&C and Asherman’s Syndrome.
No sums of money can compensate the loss of being able to conceive but compensation in this arena can include sums for specialist fertility treatments as well as financial losses incurred such as lost earnings and other treatment costs that may be needed including psychological treatments.
